OMAHA, Neb. (AP) — The federal government has joined more than a dozen former workers in suing Union Pacific over the way it used a vision test to disqualify workers the railroad believed were color blind and might have trouble reading signals telling them to stop a train.

The lawsuit announced Monday by the Equal Employment Opportunity Commission on behalf of 21 former workers is the first the government filed in what could eventually be hundreds — if not thousands — of&nbsp;<a href="https://apnews.com/article/health-omaha-410c8e04b049af6b1f8afe11084a43d9">lawsuits</a>&nbsp;over the way Union Pacific disqualified people with a variety of health issues.

These cases were once going to be part of a class-action lawsuit that the railroad estimated might include as many as 7,700 people who had to undergo what is called a “fitness-for-duty” review between 2014 and 2018.

Lawyers for the plaintiffs estimate nearly 2,000 of those people faced restrictions that kept them off the job for at least two years if not indefinitely. But the railroad hasn't significantly changed its policies since making that estimate in an earlier legal filing, meaning the number has likely grown in the past five years. More than three dozen lawsuits have been filed so far with many more cases still being reviewed by the EEOC.

Union Pacific has vigorously defended itself in court and refused to enter into settlement talks with the EEOC. The railroad has said it believes it was necessary to disqualify workers to ensure safety because it believed they had trouble seeing colors or developed health conditions such as seizures, heart problems or diabetes that could lead to them becoming incapacitated. They also noted federal rules require color vision testing.

“It is critical for the safety of our employees and communities where we operate that conductors and locomotive engineers correctly see and interpret the various signals that direct train movement,” railroad spokeswoman Kristen South said.

Often the railroad made its decisions after reviewing medical records and disqualified many even if their own doctors recommended they be allowed to return to work.

That wreck inspired a number of proposed reforms from&nbsp;<a href="https://apnews.com/article/east-palestine-train-derailment-safety-regulations-railroad-4db52c68daf68da05425b5b70363fb0a">Congress</a>&nbsp;and&nbsp;<a href="https://apnews.com/article/rail-accidents-transportation-pete-buttigieg-ohio-pennsylvania-f1cd9d79cdd66b1f45d1dcdf1e53ff58">regulators</a>&nbsp;that have yet to be approved.

“Everyone wants railroads to be safe,” said Gregory Gochanour, regional attorney for the EEOC’s Chicago District. “However, firing qualified, experienced employees for failing an invalid test of color vision does nothing to promote safety, and violates the ADA (Americans with Disabilities Act).”

This lawsuit focuses on a vision test that Union Pacific developed called the “light cannon” test that involves asking workers to identify the color of a light on a device placed a quarter of a mile (.4 kilometers) away from the test taker. The EEOC said in its lawsuit that the test doesn't replicate real world conditions or show whether workers can accurately identify railroad signals.

Some of the workers who sued had failed Union Pacific's “light cannon” test but passed another vision test that has the approval of the Federal Railroad Administration. The other workers who sued had failed both tests but presented medical evidence to the railroad that they didn't have a color vision problem that would keep them from identifying signals.

The workers involved in the lawsuit were doing their jobs successfully for Union Pacific for between two and 30 years without any safety problems. The workers represented in the EEOC lawsuit worked for the company in Minnesota, Illinois, Arizona, Idaho, California, Kansas, Nebraska, Oregon, Washington, and Texas.

Attorney Anthony Petru, who represents a number of the former UP workers, said the “light cannon” test is so unreliable that the railroad's own experts have testified that it would disqualify a quarter of the workers with perfect vision.

“The last thing we would do is take any steps to try to put anybody in charge of a freight train who is unsafe because of their physical characteristics,” Petru said. “What we don’t want is employees who are safe, who could do the job safely, who could do the job competently to be precluded from working because the railroad perceives them as having a disability when they don’t.”

Petru said Union Pacific disqualified all these workers over these vision tests “without making the railroad safer in any way, shape or form” because there's no history of UP workers causing derailments or collisions when they couldn't discern between red and green.

The Omaha, Nebraska-based railroad is one of the nation's largest with tracks in 23 Western states.

Government sues Union Pacific over using flawed test to disqualify color blind railroad workers

Phi Theta Kappa members at North Platte Community College are collecting donations for wreaths as part of the Wreaths Across America event.

The ceremony is conducted every year to remember and honor the country’s fallen heroes. The wreaths PTK members are soliciting sponsorships for will be placed on headstones at Fort McPherson National Cemetery south of Maxwell.

As part of the budgetary vision of the departing President Ted Carter, the Board of Regents (BOR) is requiring that UNK cut over $5 million from its biennium budget. To meet the demands of the Board of Regents, UNK’s administration is proposing to cut 30 faculty positions from 14 different departments and eliminate the departments of Geography, Philosophy, and Theater while removing the following degrees at UNK:

• Business Administration Comprehensive-Business Intelligence Emphasis BS

• Geography 7-12 Teaching Subject Endorsement

• Modern Languages BA with French emphasis or German emphasis

• Montessori Early Childhood Education Minor

• Music Comprehensive in business emphasis BM

• Music Performance Comprehensive in instrumental emphasis BM

In addition, staff members from a range of divisions on our campus are also looking at major losses in personnel.&nbsp;

All of this will have a negative impact on the education of our students and on their ability to consider a wide range of professional careers.

As of today, UNK is the&nbsp;only&nbsp;campus in the NU system where its administration has called for faculty and staff terminations.&nbsp;

The administration’s proposal has been submitted to a Faculty Advisory Committee that will offer feedback on this proposal, but their role is solely an advisory one.

Why has the NU Board of Regents demanded budget cuts from UNK that will have such a damaging effect on our institution?

The Board of Regents has chosen to apply budgetary pressures on the NU system that are leading to these extreme reductions instead of evaluating how it has historically utilized NU resources or assessing the administrative leaders in charge of recruitment and enrollment on the different campuses that are all facing stagnant enrollment numbers for another year.&nbsp;

For example, during the almost four years that Ted Carter has been president at NU he has received approximately $400,000 more a year than his predecessor. In fact, in 2022, the Board of Regents&nbsp;extended Carter’s contract&nbsp;through 2027, giving him a 3% pay raise, bringing his annual salary to $964,000 a year. &nbsp;At UNK, the cabinet has enjoyed raises for multiple years that far outpace the raises that staff and faculty have received.&nbsp;

How many professors and lecturers at UNK have to be fired in order to find the money for the next NU president’s salary or for the six- and seven-figure salaries of the various Chancellors, Provosts, Associate Provosts, Senior Vice Chancellors, Associate Vice Chancellors, or Assistant Vice Chancellors etc., on our various campuses?&nbsp;

In the spirit of equity and fairness, UNKEA requests that the Board of Regents reconsider the demands that it is making which will result in scores of UNK employees being laid off and the elimination of several departments and multiple undergraduate majors. This not only represents great harm to these dedicated employees and our students but also will have a negative impact on the larger community of Central and Western Nebraska.

UNKEA is calling on members of the greater UNK community to contact President Carter, members of the Board of Regents, and State Senators asking them to oppose the cuts at UNK.&nbsp; The Board of Regents needs to reflect on how it has been using our resources and develop a new plan that does not require applying such pain on the human beings that are central to the mission of UNK while simultaneously undermining the education of the students we serve.

Christmas Caring and Sharing Gift Program

Lincoln, NE – October 3, 2023 – Due to high sales, officials in the states participating in the Mega Millions® Lotto game have increased the estimated jackpot amount for the Tuesday, October 3 drawing to $315 million or $140.3 million with the cash option selected.

He earned his bachelor's degree in child, youth and family studies in December of 2022. A second case of West Nile Virus in a horse has been reported to Southwest Nebraska Public Health Department (SWNPHD) from the nine-county health district. Several additional cases of West Nile Virus in humans have been identified as well - 10 confirmed cases with symptoms and 2 asymptomatic cases identified in blood donors, bringing the total for this year to 15.&nbsp;&nbsp;

“Some of these individuals became infected while traveling in Colorado, which is also seeing a severe West Nile Virus season along with Nebraska,” stated Sarah Minnick, Program Manager at SWNPHD. “Thankfully the weather is cooling down; however, until there is a hard freeze, mosquitoes are still present in southwest Nebraska and may potentially be carrying West Nile Virus.”&nbsp;

SWNPHD encourages all horse owners to vaccinate their horses against West Nile Virus. West Nile Virus (WNV) is transmitted to horses though the bite of an infected mosquito. Horses cannot transmit WNV to other horses, birds, or people.&nbsp;

Per the Nebraska Department of Agriculture, the signs and symptoms of West Nile Virus in horses include loss of appetite, depression, fever, quivering muscles, and weakness of limbs. Infected horses may or may not show symptoms.&nbsp;

While there is no specific treatment for horses infected with WNV, the following tips can be used to help prevent infections:&nbsp;

Disney released the film in 1993 and over the years has been called one of the greatest Halloween movies of all time. The screening will take place at the Perkins County Fairgrounds on October 28th, 7:00pm mountain. Free popcorn will be offered to snack on during the movie along with donated water. The event is free will donation.&nbsp;

Nebraska Tourism Launches Second Holiday Passport including stop in North Platte

Union Pacific Railroad’s women-empowering&nbsp;<a href="https://www.up.com/up/aboutup/corporate_info/diversity/employee-resource-groups/index.htm">Employee Resource Group</a>&nbsp;– LEAD – is celebrating its 20th anniversary with a full-day conference, featuring appearances from some of the nation’s top women executives.

Tamika L. Tremaglio, Executive Director of the National Basketball Players Association, will be the keynote speaker and Missy Pearlman, General Manager of Toyota North America, will talk about the importance of being bold in the workplace.

The conference will be held Oct. 3 in Bellevue, Nebraska, and is open only to LEAD members.

Union Pacific’s LEAD was founded in 2003 to empower and foster opportunities for women. It stands for: Lead. Educate. Achieve. Develop. One of its founding members is Union Pacific President Beth Whited, the first woman to hold that position in the company’s 161-year history. She served as LEAD’s second president.

Whited is scheduled to speak at the conference, along with Union Pacific Chief Executive Officer Jim Vena and Union Pacific Chief Financial Officer Jennifer Hamann.

City of Grant reminds residents of annual trailer parking restrictions

GRANT, NEB. - Road work is to begin today on Highway 61 at the intersection of 5th Street and Central Ave in Grant.&nbsp;

The North traveling lane will be removed and replaced today and the south traveling lane will be removed and replaced Wednesday.  With the edges being removed and replaced early next week. 

During the road work, traffic will be maintained through a single lane through the intersection. The city of Grant wants to remind residents and travelers to pay attention to the barricades and signs that are posted by the state.

Road work to begin on HWY 61 at the intersection of 5th Street and Central Ave in Grant

On 9-23-23, around 7pm, a Deputy with the Garden County Sheriff’s Office responded to a 911 call from a male stating that Cowboy Tobacco was drunk and had tried to snap the caller’s neck.

When the Deputy arrived on scene and entered the residence, he observed Tobacco laying on his stomach with a hammer in his right hand. The Deputy instructed Tobacco to let go of the hammer and Tobacco complied. Once Tobacco was seated on a couch, he started becoming emotional, asking the Deputy what was going on and what he did.

When the Deputy told Tobacco about the call received, Tobacco became angry, yelling and threatening the Reporting Party. Tobacco was removed from the residence in order to try to calm him down and get his side of the story, but Tobacco began getting even more aggressive and continued yelling, stepping toward the residence and breaking a window with his fist. 

Tobacco was then placed into custody and taken to the Emergency Room to treat the cuts on his hand sustained while breaking the window. While in the ER, Tobacco was very aggressive toward medical staff and would not follow Deputies’ commands. Tobacco intentionally made a fist and would wave his hand in a flicking motion toward the Deputy, flinging blood on him. 

Tobacco had to be physically held down for medical attention and received stitches. He was eventually transported to the Cheyenne County Jail. Tobacco has been charged with Terroristic Threats, Assault Peace Officer with Bodily Fluids, Criminal Mischief, Assault 3rd Degree and Disturbing the Peace.&nbsp;&nbsp;

Ogallala Rotary Club to host Horror Nights in October

<a>The men on the Mid-Plains Community College Rodeo Team are back on top following a weekend of competition in Dickinson, N.D.&nbsp;</a>

MPCC’s cowboys and cowgirls competed Friday and Saturday at the Blue Hawk Stampede hosted by Dickinson State University.&nbsp;The Mid-Plains’ men’s team finished first in overall standings, and the women’s team was fifth.

Koby Jacobson, of Haiku, Hawaii, continued his winning streak by claiming the top spot in the bull riding average. Jett Sjeklocha, of North Platte, and Casey Reis, of Grand Island, placed third and seventh, respectively, in the event.

Kahiwa Augustiro, of Hoʻolehua, Hawaii, took the Reserve All-Around title after placing fifth in the bull riding average, sixth in the steer wrestling and eighth in the team roping alongside teammate Eli Higa, of Honokaʻa, Hawaii.

Jackson Lunn, of Whitecourt, Alberta, earned the second-place spot on the leaderboard for bareback riding.

Rex Day, of Bartlett, was second in the average for steer wrestling, and Jacobson ended up seventh.

In the team roping, Jaxton Starr, of North Platte, and Colton Zubach, representing Dickinson State University, came in second in the average. Tucker Even, of Burke, S. D., and Slater Tople, from Black Hills State University, claimed fourth. Whitney Jennings, of Seneca, and Garrett Glines, of Smithwick, S.D., were fifth, and Layton Lindner, of Broken Bow, and Ty Growcock, of Ericson, were ninth.&nbsp;

Madison McGee, of Deloraine, Manitoba, Canada, was fourth in the breakaway average, and Jace Richter, of Ogallala, took eighth in the tie-down roping.

“I was extremely proud of the kids this weekend,” said Aukai Kaai, MPCC Rodeo Team roughstock coach.&nbsp;“They took care of business inside the arena and bounced back after a tough rodeo last weekend. I am really proud of our bull riders - four of the seven made the short round. I thought we scored well and battled all weekend long. I still believe our best is yet to come, and I think a couple tweaks in the practice pen will make it all come together.”

The MPCC Rodeo Team has one more rodeo before taking a break until spring. The fall competitions will wrap up with the Buena Vista University Rodeo Friday and Saturday in Alta, Iowa.

Sutherland, Nebraska – The Village of Sutherland has awarded its first economic development grant under the new Property Improvement Program. In May of 2022, the very fiscally conservative voters of Sutherland recognized the need to collectively invest in the growth and sustainability of their community. They voted to place a tax upon themselves of 1 ½ percent. That process included the creation of the Sutherland Economic Development Program and the Citizens Advisory Review Committee to oversee the distribution of the half-percent tax that was earmarked for economic development.

The Village Board of Trustees approved three programs developed by the volunteers on the committee and the Program Administrator, Muriel Clark. The programs are the Business Development Loan and Grant, the Property Improvement Program Loan and Grant and the Digital Marketing Grant.

On September 21, the Citizens Advisory Review Committee reviewed a grant application for the Property Improvement Program from Devin and Sandi Ruff for exterior improvements to downtown Sutherland’s Sno White. The Ruffs purchased the business earlier this year and have been spending many hours cleaning up the property and improving its appearance. Development plans include creating a year-round restaurant and preserving the historic telephone exchange building that is also on the property. The CARC voted to recommend to the Village Board of Trustees funding for the exterior improvements with a grant of $10,000.

The Sno White is a Sutherland landmark, having served up ice cream and meals in the community since the 1950’s. The CARC recognized the importance of the business to the community and the fact that prepared food sales are taxable and will help to replenish the balance of the economic development fund. The committee also forwarded a favorable recommendation of a Property Improvement Program grant application from a homeowner to replace a deteriorating sidewalk but recommended that the Village adopt standardized guidelines for sidewalks throughout the community prior to funding the project.

The Village Board of Trustees agreed with the recommendation and approved funding for the Sno White at its regular monthly meeting on September 27. They also tabled approving the grant for sidewalk repair until the Planning Commission and the Board of Trustees can clarify specifications for sidewalks.

The grants awarded under the program are for reimbursement and no monies will be paid out until the project is completed to the satisfaction of the Village in accordance with the application. No part of the project contained in the application can be begun prior to the applicants signing an agreement and receiving a notification to proceed. The Ruffs plan to have the Sno White open in the spring of 2024 with the improvements completed.

The Economic Development Department will be holding an informational Open House and Town Hall Meeting on Tuesday October 24 from 7pm to 8pm in the Village offices for anyone interested in learning more about the programs.

Sutherland Awards first Economic Development Grant

Below is the city ordinance.

§ 72.08 MOBILE HOMES, TRAILERS, AND THE LIKE.(A) It shall be unlawful for any person to park or leave standing in on the streets or alleys of the city any mobile home, travel trailer, boat, boat trailer, pontoon, pontoon trailer, utility trailer, pickup camper, horse trailer, or any farm or construction machinery of any kind upon the public streets or alleys of the city, except for the purposes of loading and unloading and then only for the length of time necessary to load or unload the vehicle, trailer, or machinery; provided, however, the enforcement of this section shall be suspended during the period from April 1 to October 1 of each year if the vehicle, trailer, or machinery is parked so as to not violate any other provision of this chapter and does not create a traffic hazard due to its size or obstruction of the view of motorists or pedestrians.(B) It shall further be unlawful for any person to reside in any mobile home, travel trailer, or in any other motorized vehicle, of any kind, parked or left standing upon the public streets or alleys of the city. Below is the city ordinance.§ 72.08 MOBILE HOMES, TRAILERS, AND THE LIKE.(A) It shall be unlawful for any person to park or leave standing in on the streets or alleys of the city any mobile home, travel trailer, boat, boat trailer, pontoon, pontoon trailer, utility trailer, pickup camper, horse trailer, or any farm or construction machinery of any kind upon the public streets or alleys of the city, except for the purposes of loading and unloading and then only for the length of time necessary to load or unload the vehicle, trailer, or machinery; provided, however, the enforcement of this section shall be suspended during the period from April 1 to October 1 of each year if the vehicle, trailer, or machinery is parked so as to not violate any other provision of this chapter and does not create a traffic hazard due to its size or obstruction of the view of motorists or pedestrians.(B) It shall further be unlawful for any person to reside in any mobile home, travel trailer, or in any other motorized vehicle, of any kind, parked or left standing upon the public streets or alleys of the city.
