This morning around 7:00am MT/8:00am CT, the Sidney Police Department has announced that Nathan Robinson was captured January 23rd, at 11:30pm MT in Colorado. Robinson was spotted driving the stolen Chevrolet Cruze.&nbsp;Robinson is being held in the Fremont County Jail in Canon City, Colorado.  He is being held on Local and State Charges.

The Sidney Police Department issued a press release on Monday night about their search for a Sidney man who is wanted, and as of Tuesday at noon the man is still wanted.

The man SPD is looking for is 23-year-old Nathan James Robinson who has a warrant for his arrest in connection to Assault, Robbery and Abuse of a Vulnerable Adult.

Authorities say Robinson was last seen driving the victim's red 2012 Chevrolet Cruze Sedan bearing Nebraska license plate 39-D310. Nathan&nbsp; is described as a 5'6 white man with red hair, a bald spot and red beard.

Sidney police says wanted man has been arrested in Colorado

<a href="https://nebraskaexaminer.com/2024/01/23/new-senator-tries-again-to-make-texting-while-driving-a-primary-offense/">Nebraska Examiner</a>

LINCOLN — A record-high 19 Nebraskans lost their lives in distracted driving crashes in 2020, and a state legislative committee was urged Tuesday to do something about it.

But judging from the response from members of the Legislature’s Transportation and Telecommunications Committee, one step to do that — making texting while driving a primary offense — faces a tough road ahead, as in past years.

“Where do you draw the line?” asked State Sen. Mike Moser of Columbus, who chairs the committee.

Moser, along with some other members of the committee, posed a bevy of questions Tuesday about allowing law enforcement officers to pull over someone they see texting on a cell phone.

What would an officer have to witness? How could you prove someone was texting? Why not go after other forms of distractions, such as watching a video or talking on a cell phone or eating while driving? Would the bill be used to target drivers of color?

The questions have helped to derail several past efforts in the Legislature to make texting while driving a primary offense, which is now the law in 45 other states.

Currently, texting while driving in Nebraska is a secondary offense — like wearing a seat belt — for which a driver can be ticketed only if stopped for another infraction or if involved in an accident.

Central City Sen. Loren Lippincott, who was elected in 2022, has reintroduced the measure this year as Legislative Bill 1033, saying that Nebraska ought to join the growing number of states that are cracking down on cell phone use to reduce deaths and injuries.

“All the other states have done this. We need to get on board,” he said.

Last year, the Nebraska State Patrol wrote 112 tickets for texting while driving, an increase from the 76 citations written in 2022 and the 88 tickets issued in 2021. (The numbers include some tickets written to commercial truck drivers, who are already banned from using cell phones for any purpose while driving.)

But a Douglas County Sheriff’s lieutenant and advocates for highway safety said that making texting a primary offense has been shown to successfully change driver behavior and reduce cell phone use while driving by up to 76%.

“Driver behavior is very responsive to cell phone laws,” said Lt. Tim Owens of the Sheriff’s Office.

That office, Owens said, has investigated 35 accidents since 2019 linked to cell phone use.

In 2020 — the most recent year for which state statistics were available — there were 3,924 vehicle crashes statewide in which distracted driving was a factor, along with a record 19 fatalities, according to the Nebraska Department of Transportation Highway Safety Office.

That same office reported that 31% of crashes with drivers 19 years of age and younger involved cell phone use.

But enforcement is difficult, Owens told the committee. The sheriff’s office participated in campaigns during the past two years to crack down on driving while texting. But the “U Drive, U Text, U Pay” initiative in Douglas County, he said, resulted in no tickets being issued, which he blamed on the “weakened platform” of current state law.

Eric Koeppe of Safe Driving Nebraska said making texting only a secondary offense “sends the message” to officers and drivers that it’s not a priority.

34 states ban all hand-held cell phone use

Koeppe called LB 1033 a first step, and if the state really wanted to put a dent in distracted driving accidents and deaths, he said, it would do what 34 other states have done, which is to ban any use of a hand-held cell phone while driving.

“That’s the ultimate solution,” he said.

Koeppe added that a 2019 poll indicated that 89% of Nebraskans supported a law that allowed law enforcement to stop a driver and ticket them “solely” for texting.

But Spike Eickholt, representing the ACLU of Nebraska and the state’s criminal defense lawyers, opposed the bill. He said that law enforcement can already pull over “bad” or distracted drivers for a variety of reasons, such as driving too fast or too slow, swerving out of their lane or following too closely.

Plus, it’s already a crime — albeit a secondary crime — to text while driving, Eickholt said.

“This will do something more,” he said, empowering a police officer to pull someone over based on their observation.

Brainard Sen. Bruce Bostelman said the bill was “picking and choosing” one distraction to driving over others, and Lincoln Sen. Carolyn Bosn, a former prosecutor, questioned how an officer could prove someone was texting.

After the hearing, Lippincott said he was unsure whether someone would prioritize LB 1033, which would help its chances of being advanced by a clearly skeptical Transportation Committee and advancing to debate by the full Legislature.

There might be one glimmer of hope: In August, Gov. Jim Pillen&nbsp;<a href="https://nebraskaexaminer.com/briefs/pillen-says-we-need-a-serious-conversation-about-cell-phone-use-and-distracted-driving/">described an incident</a>&nbsp;in which a distracted driver forced the vehicle in which he was riding off the road.

His comment then was that some “serious conversations” were necessary on the issue of distracted driving.

New senator tries again to make texting while driving a primary offense

Acting United States Attorney Susan T. Lehr announced that on January 23, 2024, an operation led by the Federal Bureau of Investigation and Nebraska State Patrol led to the arrest of 19 people and the unsealing of at least nine indictments. Those arrested and a summary of their charges and the penalties include the following.

An indictment was unsealed charging&nbsp;<a>Alejandro Ruiz (age 41), of California, Guadalupe Ramirez (38) of North Platte, Roberto Duran (33) of Brule, Michael Shawn Harrell (47) of Ogallala, Eduardo Gomez (33) of North Platte and Carl McKinney (37) from Kentucky, with conspiracy to distribute over 500 grams of methamphetamine between January of 2021, and January of 2022. A conviction on that charge carries a possible penalty of not less than 10 years to life in prison, a fine of up to $10 million; and a term of supervised release not less than five years. Ramirez, Gomez, and Harrell also face charges of possessing a firearm during and in furtherance of a drug trafficking crime.&nbsp; If convicted, they each face a term of imprisonment of five years to life, consecutive to the drug charge; a $250,000 fine and up to 5 years of supervised release.&nbsp; Harrell was also charged with being a felon in possession of a firearm. A conviction of that charge carries a penalty of not more than 10 years’ imprisonment, a $250,000 fine and up to three years of supervised release.</a>

An indictment was unsealed charging Jamie Hopkins (37), Michael Stroble (30); Joey Romero (36), and Luke Schwartz (30) all of North Platte, with conspiracy to distribute 50 grams or more of methamphetamine (actual) and distribution of meth between July 2022 through February of 2023. The penalties are not less than 10 years to life in prison, a fine of up to $10 million; and a term of supervised release not less than five years.

An indictment was unsealed charging Jessica Binegar (37) of North Platte, John Hernandez (35) of Lincoln and Brad Leeper (46) of North Platte with distribution of 5 grams or more of meth (actual) between March and June of 2022.&nbsp; Leeper was also charged with being a felon in possession of a firearm.&nbsp; The possible penalties for distribution are not less than five years, nor more than 40 years in prison; a fine of up to $5 million; and a term of supervised release following the prison term of not less than four years.

Wesley Kraft (36) of Lincoln, was charged with distribution of five grams or more of meth (actual) during April of 2023 and being a felon in possession of a firearm.

Timothy Huisman (39) of North Platte, was charged with distribution of five grams or more of meth (actual) in February of 2023. Shane Ross (46) of Ogallala, was charged with distribution of five grams or more of meth (actual) in July of 2022. Richard Torres (44) of Brule, was charged with conspiracy and distribution of more than five grams of meth (actual) between December 2021 and August of 2022.

Timothy Maisner (62) of North Platte, with possession with intent to distribute of 50 grams of more of methamphetamine (actual) and distribution of methamphetamine during January and July of 2023.&nbsp;

Eddie Houpt (59) of North Platte, was charged with distribution of five grams or more of meth (actual) in June of 2022.

 NSP & FBI Drug Task Force Operation Leads to 19 Arrests, including North Platte, Ogallala natives

LINCOLN, Neb. – Nebraska USDA Farm Service Agency (FSA) is reminding producers now is the time to make elections and enroll in the Agriculture Risk Coverage (ARC) and Price Loss Coverage (PLC) programs for the 2024 crop year. The signup period is open through March 15, 2024, and producers are encouraged to begin working with their USDA county Farm Service Agency (FSA) office to complete the process.

Producers can learn about the ARC and PLC options for 2024 during a series of workshops hosted by the University of Nebraska-Lincoln’s Center for Agricultural Profitability (CAP) and Nebraska FSA that will be held across the state in February.&nbsp;

ARC and PLC are key USDA safety-net programs that help producers weather fluctuations in either revenue or price for certain crops.

“Safety-net programs like ARC and PLC are designed to help producers mitigate some of the financial stressors associated with crop production. I encourage farmers to evaluate their program elections and enroll for the 2024 crop year,” said Nebraska FSA Acting State Executive Director Tim Divis.

Brad Lubben, Nebraska Extension policy specialist, said changes in commodity crop prices over the past several years may influence producers’ ARC/PLC decision-making process for 2024.

“With the one-year extension of the 2018 Farm Bill, producers face a familiar choice between ARC and PLC for 2024, but under different circumstances now as compared to the past several years,” said Lubben. “Understanding the program mechanics and analysis will help producers make sound enrollment decisions with FSA.”

ARC provides income support payments on historical base acres when actual crop revenue declines below a specified guaranteed level.  </figure>LINCOLN, Neb. – Nebraska USDA Farm Service Agency (FSA) is reminding producers now is the time to make elections and enroll in the Agriculture Risk Coverage (ARC) and Price Loss Coverage (PLC) programs for the 2024 crop year. The signup period is open through March 15, 2024, and producers are encouraged to begin working with their USDA county Farm Service Agency (FSA) office to complete the process.Producers can learn about the ARC and PLC options for 2024 during a series of workshops hosted by the University of Nebraska-Lincoln’s Center for Agricultural Profitability (CAP) and Nebraska FSA that will be held across the state in February.&nbsp;<ol>

 </figure>The Sidney Police Department issued a press release on Monday night about their search for a Sidney man who is wanted, and as of Tuesday at noon the man is still wanted.The man SPD is looking for is 23-year-old Nathan James Robinson who has a warrant for his arrest in connection to Assault, Robbery and Abuse of a Vulnerable Adult.Authorities say Robinson was last seen driving the victim's red 2012 Chevrolet Cruze Sedan bearing Nebraska license plate 39-D310. Nathan&nbsp; is described as a 5'6 white man with red hair, a bald spot and red beard.<figure>

Scottsbluff Police promotes three officers, welcomes two new officers

Renowned vocalist Dr. Andrew White sings in the North Platte Community College McDonald-Belton Theater Friday evening while accompanied on the piano by NPCC music instructor Kristin Simpson.

White started the evening off with a lecture about Austrian composer Franz Schubert and Schubert’s Winterreise song cycle. White and Simpson then performed the song cycle for the public.

Lincoln County Cattlemen’s meeting will be held Wednesday, January 31, 2024, at the Lincoln County Fairgrounds Ag Building.&nbsp; It will start with a social at 5:30 pm and the meal at 6:00 pm.&nbsp; Speakers will start presenting at 6:30 pm.

The topics and speakers for the meeting are Mary Drewnoski, discussing Corn Residue Nutrition for Cows.&nbsp; She has been working on a statewide study to look at how some of these new hybrids may be affecting the nutrition a cow gets from the corn, corn husks and leaves.&nbsp; She will report the results of this statewide study.&nbsp; Randy Saner and area producers will discuss ways to hold down cow cost with the current inflationary rise in prices.&nbsp;

This disc golf tournament is an official event sanctioned by the Professional Disc Golf Association (PDGA) where all participants are required to be current PDGA members. 

Prospective participants who are not currently PDGA members will be provided with the opportunity to acquire PDGA membership during the registration process.&nbsp;

Scheduled to take place on March 16-17, 2024, at the Cody Park Disc Golf Course and the River’s Edge Golf Course, the Flatrock Pro/Am promises to be a captivating three-round b-tier tournament. The tournament kicks off on Saturday, March 16th, with players engaging in the first two rounds. The Mid-Plains Community College Rodeo Team will host its annual scholarship banquet on March 2 at Venue 304 in North Platte. The social hour will begin at 5:30 p.m. followed by a prime rib dinner at 7 p.m.

Meet The Rancher: Arthur rancher braves wild winter weather

LINCOLN — Questions are being raised about the recent purchase of semi-automatic rifles by the Nebraska Racing and Gaming Commission, and whether a December report sufficiently answered whether the state could handle more racetrack/casinos.

The questions come as the commission, which has ramped up to 25 employees since the opening of casinos in Nebraska 16 months ago, will meet Friday to discuss the gun purchase and whether a new analysis is needed about whether more than six racetrack/casinos should be allowed in the state.

That&nbsp;<a target="_blank" href="https://racingcommission.nebraska.gov/application/files/2117/0422/5165/Gaming_and_Horseracing_Market_Analysis_and_Socioeconomic_Study_12-26-2023.pdf">111-page “market analysis”</a>&nbsp;issued late last month concluded that Nebraska didn’t need any additional racetracks. That dealt a blow to several communities across the state that want to apply for a state permit to open so-called “racinos,” a racetrack with a casino.

At least two members of the commission — Tony Fulton and Shane Greckel — along with State Sen. John Lowe told the Examiner on Thursday that the recent report was incomplete.

Lowe, who heads the committee that deals with gambling in the Nebraska Legislature, said the report barely mentions the impact on the horse racing industry in the state.

“I think the whole study needs to be redone,” the senator said.

Fulton, a former state senator and state tax commissioner, said the report didn’t cover all the topics&nbsp;<a href="https://nebraskaexaminer.com/2023/02/28/proponents-of-expanding-casinos-beyond-existing-six-racetracks-won-a-round-in-the-legislature/">required by the Legislature, which ordered the study</a>&nbsp;to help determine whether the state could support more casinos and horse racing.

Currently, casinos are only allowed at the existing racetracks in Lincoln, Grand Island, Omaha, Columbus, South Sioux City and Hastings. Several communities, including Bellevue, Norfolk, North Platte, Fremont, Kimball and York have also expressed interest in opening casinos.

Another member of the Gaming Commission, Shane Greckel of Bloomfield, also said the study was incomplete.

“It definitely needs an amendment or addendum,” Greckel said. “It never even highlighted anything of the value to agriculture that racing brings.”

Two organizations — Warhorse Gaming and the Nebraska Horsemen’s Benevolent and Protective Association — sent letters to the commission this week, calling for a new study of whether more racinos should be allowed.

Among the concerns raised by Lance Morgan of Warhorse Gaming was that the study was premature because every casinos in the state has yet to fully open, thus their impact couldn’t be accurately measured.

The study was done by The Innovation Group, a gaming consulting business based in New Orleans, that was paid $48,000 for its analysis.

The analysis of whether new racinos are needed might come into play Friday when the Racing and Gaming Commission is scheduled to vote on whether to allow the transfer of the quarterhorse racing license in Hastings to Ogallala. That would allow the opening of the first casino in the state west of Grand Island.

The market analysis on the impact of more racinos came a month after members of commission learned, to their surprise, that the agency had purchased 10 short-barrel, semi-automatic rifles for use by its 10 plain-clothes investigators.

The Sig Sauer MPX rifles, plus associated equipment, cost $30,350. Commissioners learned about the purchase in November and were later told that the guns would be used only as “a last resort” in the event of an active shooter event at a casino or racetrack. The firearms, officials said, would not be carried on the casino floor, but would be kept within easy access in the event of an incident.

“You have to meet force with force,” said Steve Eppens, a former Lancaster County deputy sheriff who is an investigator with the commission. Most active shooter incidents involve assault rifles, he said.

Steve Anderson, the director of enforcement at the commission, said all his investigators are sworn law enforcement officers who regularly train with weapons.

He said that there have been nine shooter-related incidents at casinos since 2018 and that the MPXs are the same weapons used by the Nebraska State Patrol for its SWAT teams.

Said Eppens, “If you don’t think active shooter incidents happen at casinos, just Google it.”

Lowe questioned whether the Gaming Commission needs such firepower.

“This is a regulatory agency,” he said.

The State Patrol, the senator added, is there to deal with shooting incidents.

Both Fulton and Greckel said that once an explanation was provided to justify the gun purchase, they agreed with it.

But the two commissioners said that the decision to buy the guns could have been handled better and that the commission is now adopting guidelines on how such purchases should be approved.

Tom Sage, the executive director of the Racing and Gaming Commission, said in a recent interview that the guns were purchased to be “proactive.”

“We’re trying like hell to make sure we don’t have a big issue at a casino and then we hear, ‘we told you so,’ ” Sage said.

He said that criminal activities do occur at casinos, mentioning sex trafficking, drugs, fraud and gang-related activity. Sage added there was a fatal shooting at Fonner Park in March.

Sage recently took a leave of absence to deal with personal health issues and was unavailable to respond to questions raised about the market analysis of racinos.

‘I’ll put our record up against anyone’

But in a recent interview with the Examiner, he defended the steps he’s taken in recent months to ramp up the commission to deal with a new industry, gambling casinos.

The organization, Sage said, had to hire new staff and learn about a totally new activity in the state and how to regulate it.

Both he and the agency’s lawyer, Ryan Forrest, said that’s brought a lot of pressure to bear and long hours.

“You can’t make everyone happy,” Forrest said.

Added Sage, “I’ll put our record up against anyone.”

On Tuesday, Ogallala had a close battle with #4 Scottsbluff (Class B) but pulled out on top 71-65. The Bearcats, who trailed by 17 in the third quarter made a late run to cut the lead down to 4 in the fourth quarter, but the Indians free throw secured the victory. Senior Caden Rezac had a team high of 19 points and sophomore Sawyer Smith finished with 14 points.&nbsp;

The Alliance Bulldogs (5-7) defeated Gordon-Rushville on Tuesday in dominating fashion, 73-18. Three Bulldogs finished with double digits in scoring led by sophomore Espen Lanik who had 21 points, junior Seth Meyring finished with 13 and senior Tristen Timbers had 12. Alliance started the year off 0-3 but have got the engine turning.&nbsp;

The North Platte Community College Theater Department will host open auditions for its spring play next month.

The play, “Plan 9 from Outer Space,” is adapted from the science fiction horror film of the same name from the 1950s that was produced, written and directed by Ed Wood.

The plot focuses on aliens seeking to stop humanity from creating a doomsday weapon that could destroy the universe. The extraterrestrials come up with “Plan 9,” a scheme to resurrect Earth’s dead. The aliens hope that by causing chaos, humans will listen to them, and if not, there will be no choice but to destroy mankind with zombie armies.

This stage adaption will be part homage and part mockery of the cult classic film.”There are parts in the play for up to six men and six women ages 16 and older. Technical crew positions are also available. No previous acting experience is required.Auditions will begin at 6 p.m. Feb. 13 in the McDonald-Belton Theater on the NPCC South Campus, 601 W. State Farm Rd.
